Can you file a claim for Social Security benefits as a result of chronic venous insufficiency? Do you have DVT or phlebitis?

Vascular Web explains that chronic venous insufficiency happens when your leg veins can’t pump enough blood back to your heart. When you’re in an upright position, the blood in your leg veins goes against gravity to return your heart. Your leg muscles squeeze the deep veins of your legs and feet and move the blood back to your heart. There are one-way flaps, called valves, to keep the blood flowing in the right direction and, when your leg muscles relax, the valves inside your veins close preventing the blood from going backwards into your legs.

When you sit or stand for a long period of time the blood in your leg veins can pool and increase the pressure. Sitting or standing for a long time can stretch the vein walls so that they become flexible and over time weakened the walls of the veins.

Chronic venous insufficiency can be caused when blood pressure is higher than normal inside your legs. Other causes include deep vein thrombosis (DVT) and phlebitis which cause elevated pressure in your veins which overloads your valves.

Skin disorders are evaluated under Listing of Impairments Section 8.00.

The Social Security administration evaluates skin disorders that can result from “hereditary, congenital or acquired pathological processes.” In evaluating the existence and severity of a skin disorder on the Social Security Administration wants “information about the onset, duration, frequency of flareups, prognosis and the location, size and appearance with lesions.” When appropriate, they will want a “history of your exposure to toxins, allergens and irritants, and familial incidence, seasonal variations, stress factors and your ability to function outside a highly protective environment.”

Laboratory findings or other medical evidence must be submitted.

The Social Security administration assesses the severity of a skin disorder based on the extent your skin lesions cause restriction of motion of your joints or use of your extremities, your ability to do fine and gross motor movements of your hands and your ability to walk.

They will also consider the frequency of your flareups, your symptoms including pain, and your treatment. This listing also considers the effects of medication, therapy, surgery or other treatment.

The Social Security Administration will also assess impairment that affects the skin and other body symptoms such as connective tissue disorders and other immune disorders.

Administrative Law Judges seem to have problems with credibility determinations of Social Security disability applicants with lupus. The Administrative Law Judge (ALJ) can find your testimony is not credible if your subjective complaints are not consistent with your daily activities. However, the judge can not reject your testimony about your daily activities unless the judge gives clear and convincing reasons. The judge can’t reject your testimony out of hand.

A judge can’t reject the testimony about your daily activities provided by a neighbor or a family member. The courts have repetitively held that lay testimony is competent evidence that a judge must take into consideration unless they give very specific reasons for rejection of that testimony.

Make sure that your testimony about your symptoms and problems is consistent with your activities. If you have fatigue or side effects of medication, you are not out running a marathon!
