Can your claim for Social Security disability benefits based on Crohn’s disease be denied if you stop taking your medication?

At hurdle 2 of the Social Security evaluation process, you would have to show that you have a severe impairment. Social Security Law says that if you have a condition that can be controlled or cured and you don’t take your medication, you are not qualified for disability benefits.

However, there is an exception. If you can’t afford treatment for Crohn’s disease, your condition has to be evaluated without regard to whether it can be “remediated”.

If you stop taking your medication because of your inability to buy the medication, your condition will be considered a severe impairment.
